Terms & Conditions

DISCLAIMER

  1. Mr Geeks will only perform and provide computer services, repairs, and upgrades as requested by the customer. Mr Geeks will conduct honest, reasonable, and considerate services. The goal is to provide the highest quality of service and support, but specific results cannot beguaranteed.
  2. Computer service/repairs are provided as a service. There may be circumstances under which your computer can not be repaired. It will have to be rebuilt or upgraded. (Examples: Age of PC, repair/replacement parts obsolete, memory chips, motherboards,etc.)
  3. The length of time required to service/repair your computer cannot be predicted. (See para 2.1below)
  4. You understand that in the process of working on your computer equipment, there is a potential for data loss. You agree that you have made the necessary backups of your data so that, in the event of such loss, the data can be restored. Mr Geeks will not be responsible for data loss. (See para 4.4 and sect 8below)
  5. You authorize the technician(s) providing the service or repair to install anti-virus and any other necessary software on your computer to perform required services. All repair software will be deleted / uninstalled upon completion of the service.
  6. Labor warranty is 15 days excluding adware/virus/malware infections. If file sharing program such as frostWire,torrents, or risky behavior are found to be the cause of reinfection it would be considered a new infection and subject to be billed

BOOKING AND CANCELLATION TERMS CONDITIONS

  1. Computer services/repairs are billed as stated on the service order provided. Charges will be calculated in onehour increments, and carry a minimum one hourcharge.
  2. An estimate of cost for work will be provided before performing computer services/repairs. Estimates are not guaranteed.
  3. In the case that there is an unforeseen deviation, beyond the above estimated amount, every effort will be madeto contact you and inform you of the situation and receive authorization to continue or stop at the estimatelimit.
  4. Fees for cancellations /no shows /late appointments. To cancel your in-home or office service request, you must contact us at (314) 649-3941 at least 3 hours prior to the scheduled service. Cancelations that do not occurs within this time frame may result in a $100 cancellations fee. If you are not at home or business at the time of appointment, a no show fee of $100 applies.
  5. . For in-home or in-office services, a person of at least 18 years of age must be present during the entire period services are provided. If no adult is present when the technician arrives, services can be denied and a $100.00 cancelation fee will be charged. Our technicians are familiar in the protocols of computer hardware and software installation, troubleshooting and configuration, but are not official OEM authorized service technician.

PAYMENT TERMS

  1. Full payment is due upon completion of services, upgrades, orrepairs.
  2. Computer parts, hardware, or/and software that are ordered or special ordered must be paid inadvance.
  3. Mr Geeks accepts cash, checks, and creditcards.

LIABILITY

  1. Service(s) are provided in an effort to fix, upgrade, or otherwise repair the computer system(s) for which you request suchservice(s).
  2. Your system will not be intentionally harmed. The primary goal is to fix your computer, not damageit.
  3. Inthe caseofaccidentaldamageofdatatoyoursystemordatalosscausedbyalreadyexistingproblemsinyour system such as viruses, poorly configured software, or hardware problems/failures; You agree to hold Mr Geeks and any person(s) associated with Mr Geeks or involved in the work being done for you harmless from damages resulting from such problems.
  4. It is your responsibility to back up your data. Mr Geeks will not be responsible for data loss. (See para 1.4 above and sect 8below)

LAWS

  1. Laws. The Service Terms shall be governed by and construed in accordance with the laws of the State of Missouri, excluding its conflict of law provisions. Customer and Mr Geeks agree to submit to the exclusive jurisdiction of the courts in St. Louis, MO. If any provision of the Service Terms is held by a court of competent jurisdiction to be contrary to law, then such provision shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. Customer and Mr Geeks agree that any cause of action arising out of or related to this Service must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred.

REPAIRS & SERVICE GURANTEE

  1. All services and repairs are guaranteed for 10 days from the completion / acceptance date on the ServiceOrder.
  2. If later found that the service or repair was incorrectly diagnosed by the technician. Then Mr Geeks will perform the repair/service free of any labor charge up to $100. New parts will be charged to thecustomer.

ESTIMATES

  1. Free Estimates. All repair estimates arefree. (See para 2.2, 2.3, and 2.4above)

BACKUP OF DATA

  1. 8.1 The customer is responsible for the backup of data on theircomputer.
  2. At request of the customer, Mr Geeks will back up data for an additionalfee.
  3. The data backup process is an automated software that copies files to be backed up to one of the Mr Geeks file servers. Backed up files can be stored on these servers for up to three (3) months after the invoice date at which point they will bedeleted.
  4. Windows and program files folders will not be backed up without a specific written request from thecustomer.
  5. Mr Geeks will not be held responsible for files that are not backed up andlost.
  6. Mr Geeks is in no way responsible for the content of the customer’sfiles.

AMENDMENTS TOTERMS & SERVICE

  1. Mr Geeks may change the terms and conditions of the Service from time to time. Upon any such change, Mr Geeks will notify you by posting the changes to the site from which the Service was purchased. Mr Geeks reserves the right to modify or discontinue the Service with or without notice to you. Mr Geeks shall not be liable to Customer or any third party should Mr Geeks exercise its right to modify or discontinue the Service. Customer’s use of the Service constitutes an affirmative agreement by Customer to abide and be bound by these Service Terms and its modifications.

INDEMENIFICATION

  1. You agree to indemnify, defend, and hold harmless Mr Geeks (and its affiliates and their respective officers, directors, employees and agents) from and against any and all losses, costs, obligations, liabilities, damages, actions, suits, causes of action, claims, demands, liens, encumbrances, security interests, settlements, judgments, and other expenses, (including but not limited to cost of defense, settlement, and reasonable attorneys’ fees) of whatever type or nature, including, but not limited to, damage or destruction to property, injury (including death) to any person or persons, which are asserted against, incurred, imposed upon or suffered by Mr Geeks by reason of, or arising from: (a) Customer’s breach of this Agreement; (b) Customer’s actual or alleged infringement of any patent, copyright, trademark, trade secret or other property or contract right of any other person; (c) Customer’s actual or alleged failure to promptly pay sums due Mr Geeks or third parties; (d) Customer’s failure to comply with applicable laws, regulations or ordinances; or (e) the acts or omissions of Customer (or its officers, directors, employees or agents).
